1. Acceptance of Terms

By using our website or booking our services, you confirm that you accept these Terms & Conditions and agree to comply with all applicable laws and regulations.

If you do not agree, please do not use our services.

2. Services Provided

We offer professional photography, videography, editing, and related creative services for weddings, engagements, family events, portraits, corporate sessions, and other occasions.

All services are subject to availability, scheduling, and confirmation.

3. Bookings & Payments

• Bookings are confirmed only after acceptance by us and, where required, receipt of a deposit.
• Remaining balances must be paid according to the agreed invoice or contract terms.
• Prices are listed in Canadian Dollars (CAD) unless otherwise stated.
• We reserve the right to cancel or refuse bookings suspected of fraud, misuse, or inappropriate conduct.

4. Cancellations & Rescheduling

• Deposits may be non-refundable unless otherwise agreed in writing.
• Rescheduling requests are subject to availability.
• If a client cancels close to the event date, cancellation fees may apply.
• In the event of emergencies beyond our control, we will make reasonable efforts to reschedule or provide an alternative solution.

5. Client Responsibilities

Clients agree to:

• Provide accurate booking and event details
• Ensure timely access to venues or locations
• Obtain required permissions for photography locations
• Inform us of important schedules, cultural customs, or restrictions
• Cooperate during sessions to help achieve desired results

We are not responsible for missed coverage caused by delays, restrictions, or inaccurate information provided by the client.

6. Creative Style & Delivery

• Clients acknowledge that they have reviewed our portfolio and understand our editing and shooting style.
• Final images and videos are delivered at our professional discretion.
• Raw/unedited files are not included unless specifically agreed.
• Delivery timelines may vary depending on project size and season.

7. Copyright & Usage Rights

Unless otherwise agreed in writing:

• All photographs, videos, and creative works remain the copyright property of Moment Trackers.
• Clients receive personal-use rights to delivered media.
• Commercial use, resale, editing, or reproduction for business purposes requires written permission.

8. Promotional Use

We may use selected photos or videos for our portfolio, website, advertising, or social media unless the client requests written confidentiality before the event.

9. Limitation of Liability

To the fullest extent permitted by law, Moment Trackers shall not be liable for indirect, incidental, or consequential damages arising from:

• Delays due to weather, traffic, venue restrictions, or emergencies
• Equipment failure despite reasonable backup measures
• Missed moments caused by client or third-party delays
• Losses beyond our reasonable control

Our total liability shall not exceed the amount paid for the booked service.

10. Website Use

You agree not to:

• Use the website for unlawful purposes
• Attempt unauthorized access to systems
• Copy or misuse website content without permission
• Upload harmful software or malicious code

11. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect and protect your information.

12. Governing Law

These Terms & Conditions are governed by the laws of Ontario, Canada and applicable Canadian laws.

13. Changes to Terms

We may update these Terms & Conditions at any time. Revised versions will be posted with an updated effective date.
